Tort Legislation is a state issue so long as the state does not interfere with the 7th Amendment right to a jury trial for "matters at common law, where the value in controversy shall exceed twenty dollars…" Beyond protecting this individual right in the 7th amendment, the federal Congress should keep itself out of a matter left to the states and protected as such by the 10th Amendment.
